| Abstract: | 2003年，地方自治法が改正され，新たに指定管理者制度が導入された。これにより，民間企業を含めた「法人その他の団体」に，「公の施設」の管理運営を，使用許可権限をも含めて包括的に委託することが可能になった。「公の施設」には，公立図書館も含まれることから，この管理を指定管理者に委ねようとする地方公共団体が増えつつある。周知のように，公立図書館は，その利用が無料とされ，収益性を前提としない施設であることから，そもそも指定管理者制度はなじまない，との反対論が，図書館関係団体等から強力に展開されてきた。しかし，その主張のなかには，指定管理者制度固有の問題と言えるか疑問のあるものなどが含まれ，有効な反対論になっていないように思われる。そこで，本稿では，「公の施設」を含む公共財の提供は，国家ないし地方公共団体の主要な役割であることを確認し，その役割をアウトソースする際の法的限界の所在を探るとともに，公立図書館への指定管理者制度の導入が如何なる場合にその限界を超えるかを検討する。 | | The local Autonomy Act was revised in 2003, and a newly designed administrator systemwas introduced. By this, outsourcing of management for public facilities was permitted,inclusive with local licensing authorities. The number of local governments introducing thissystem has been increasing. On the other hand, the parties related to public libraries objected to this system stronglybecause public libraries are free to use and its facilities do not seek profits, therefore theythought this system was not fit to be introduced. However, from the point of view, in my short essay as to the contents of this revisionsome remain in question whether or not this system is viable. I want to confirm that it is primarily the role of national or local governments to offer thepublic goods inclusive with public facilities and furthermore to consider how introducing thedesignated administrator system for the public libraries exceeds existing limits, taking thelegal limitations for outsourcing into consideration. |
